Mr. Austin's practice specializes in the representation of financial institutions and other business entities in civil matters. Mr. Austin regularly represents financial institutions, corporations and individual clients in matters involving, among other things, creditor's rights in bankruptcy cases, real estate and other loan workouts, business disputes, and litigation at all levels. Services specifically provided include:
- Loan Restructurings, including review and analysis of loan documents for documentation concerns, perfection of collateral concerns, and preparation of any necessary modification, amendment or forbearance agreements
- Real and Personal Property Foreclosures, including title work, foreclosure proceedings, preparation of real property confirmation actions in cases where deficiency judgments are to be obtained, preparation for and conducting of confirmation actions, suit preparation and trial to judgment, and collection of deficiency judgments
- Bankruptcy Representation, including attending Section 341 Meetings of Creditors and filings of Motions to Modify Automatic Stay when necessary in order to release a client's collateral from the jurisdiction of the United States Bankruptcy Court. In addition, Mr. Austin' bankruptcy services include filings of Objections to Confirmation of a commercial or consumer debtor's plan of reorganization, prosecuting adversary proceedings in order to avoid having a client's debt discharged, conducting Rule 2004 examinations, and having appraisers testify regarding the value of collateral when necessary
- Bank-Related Litigation in all non-regulatory matters involving a bank or other financial institution. Mr. Austin is available to represent financial institutions in defending against Uniform Commercial Code issues, garnishments, and other actions brought against banks. He is also able to assist financial institutions in interpleader, collection, or other matters where the financial institution is asserting an action against other parties
- General Litigation in all civil matters needed by a client. The services available include representation of businesses in disputes in either state or federal court
